In these Terms and Conditions for Creative Pair Studio Pty Ltd may be referred to as ‘US’, ‘OUR’ or ‘WE’.
We/our /us refers to Creative Pair Studio Pty Ltd
You refers to the customer, you.
All content on this website is property owned by Creative Pair Studio Pty Ltd. This includes graphics, logos, images, text and website design. Therefore, any unauthorised use of them is strictly prohibited and could result in criminal or civil penalties.
All pricing is in Australian dollars and includes GST. WE have the discretion to change prices with or without notice to you. All credit cards, debit cards and cash transactions are charged in Australian dollars. All goods and services listed on the website, their information and prices are each subject to change. WE reserve the right to modify, suspend or discontinue the provision and/or sale of any goods or services with or without notice to you.
WE will make every effort to deliver OUR services to you, as promised.
On occasion however, the commencement of a session may be delayed due to circumstances beyond OUR control or unforeseen by US, partly or wholly.
It remains OUR sole discretion to decide whether a session will commence, albeit late, or whether to cancel it altogether. If WE elect to cancel a session, whether it be prior to the schedule starting time or after, WE will notify you as soon as practicably possible. Where WE choose to cancel a session, WE will provide you with a credit to the value of your purchase. Please refer to the terms and conditions of OUR Reschedule Policy.
WE reserve OUR right to change the artist hosting any session.
You acknowledge that WE may take photographs and videography of the sessions, which may record images of you at the session. By booking and attending a session, you expressly and impliedly authorise and permit US to use any recordings WE make, which may include images of you, for the promotion and advertising of OUR business. You agree that all recordings of any nature shall become OUR property and WE may use the recordings for promotional and advertising purposes for OUR benefit at OUR sole discretion. You also agree that WE may modify the recordings as WE see fit for OUR purpose.
If you do not wish for US to record your image WE ask that you notify US no later than at the starting time of the session.
Promotional and discount codes cannot be used in conjunction with any other offer unless otherwise noted by US.
In no event shall WE be liable to you or any third party for any loss or profit or any indirect, consequential, exemplary, incidental, special or punitive damages arising from or under, related to or connected with your use of the website or OUR services. Accessing and using the website and goods and services offered by US are at your own discretion and risk. You are solely responsible for any damage to your computer system, mobile device or other electronic device or loss of data resulting therefrom. WE act to the best of OUR ability to ensure that the content of the website, including all information and listings are correct, but it is subject to change at any time and without notice to you. To the extent permitted by law, WE disclaim all liability for any errors, omissions or misleading information. You agree to make your own evaluation of the suitability, accuracy and completeness of any information, advice or other content that is available on the website before you rely upon it. As a condition of use of the website, you agree to indemnify US from and against any and all liability, damage and loss whatsoever that WE incur or suffer as a result of any action, inaction or omission on your part.
Warranties
To the maximum extent permitted by law, WE disclaim any warranties, assurances or promises, express or implied, regarding the website and any goods and services or facility it provides.
Third Party Goods and Service Providers
Where goods and/or services are provided to you by a third party at a session (such as the provision of food or drink to you at OUR studio or a session held at a third party venue), you acknowledge and agree to hold US harmless and to indemnify US against any injury, damage or loss you may suffer whatsoever arising from or under, related to or connected with the provision of the third party goods and services to you.
You agree that you shall only consume alcohol during our public sessions and private events if you are over the age of 18 years. You may require suitable identification to prove your age. If we believe that you are under the age of 18 years and you intend to consume or have consumed alcohol during OUR public sessions or private events, WE have the right to ask to leave without compensation. Guests will not be permitted into OUR studio or participate in any off-site public session or private event if you are intoxicated or WE believe you are intoxicated.
WE reserve the right to change and/or modify all or any part of OUR terms and conditions, refund policy and privacy policy at any time without notice to you.
Refund policy
What if I need to change my booking?
If you need to reschedule, please call us to arrange transferring to another class.
OTHER IMPORTANT INFORMATION:
· Credit Vouchers: Credit vouchers may be used to book into any upcoming session within the next 1 year from the date it is issued.
· No Show: Due to limited seating, if you submit your request within the applicable ‘No Show’ period or you fail to attend your session or event, you will be considered a ‘No Show’ and you will not be eligible to reschedule your booking and no credit voucher will be issued or refund given.
· Cancellations: A request to cancel seats shall be treated as a request to reschedule seats and the applicable reschedule policy terms and conditions apply.
WE will make every effort to deliver OUR services to you, as promised.
On occasion, however, WE may need to reschedule a session where insufficient bookings are made. WE will do OUR utmost to provide sufficient notice to you about any session rescheduling. In the interest of avoiding a session rescheduling, WE may elect to reschedule the session at a time which you may consider you received insufficient notice due to your circumstances. WE apologise to you in advance for any inconvenience caused.
Where WE elect to reschedule a session, WE will provide you with a credit to the value of your purchase.
WE will make every effort to deliver OUR services to you, as promised.
However, if WE are required or effectively required by the Government to close OUR studio (whether it be the Federal or relevant State government, municipality or other governing body, hereunder “Government”), and WE are therefore unable to run the session/event you are booked into, WE will issue you a credit for the full value of your order which you can use to reschedule yourself to another session of your choice of equivalent value (subject to availability).
If WE are required to or effectively required to reduce the capacity of OUR studio rather than close, WE will issue a credit for the full value of your order which you can use to reschedule yourself to another session of your choice of equivalent value (subject to availability) for those guests that placed their order exceeding the reduced studio capacity.
Method of Payment is Irrelevant
The terms and conditions of this Reschedule Policy apply whether you paid in cash, by credit card, debit card, a third party payment gateway, with an e-Gift voucher or credit.
Refund Policy for e-Gift Vouchers
Please make a considered decision before purchasing OUR e-Gift Vouchers as we do not offer refunds upon purchase.
Cancellation Policy for Private Events
Please refer to OUR Private Event Terms and Conditions regarding deposits, fees involved when rescheduling or cancelling your event. Note the terms Private Event and Private Party are used interchangeably and each has the same meaning as the other.
PRIVATE EVENTS
These Terms and Conditions set forth the legally binding terms and conditions for your use of the website and any use and/or purchase of goods and services offered by Creative Pair Studio Pty Ltd and any of its related companies (hereunder ‘US’, ‘OUR’ or ‘WE’). By accessing this website you agree to comply with these terms and conditions. You warrant that you have the ability to enter into transactions directly with US and by making a request through the website you also warrant to US that you are at least 18 years of age.
What do we paint?
Upon securing your booking, we will email you our Gallery of original artwork for you to choose from or we can create a unique painting specifically for you. The cost for us to create this unique painting varies depending on your needs. Contact us to discuss.
At what times can we hold our event?
We’re open 6 days a week. We have allocated time-slots for all private events.
Your 3-hr adult paint and sip event can be held between these time slots:
Saturday Events: between 10am to 1pm or 2pm to 5pm
Sunday Events: 10am to 1pm or 1pm till 4pm
Evening Events: 6pm till 9pm
Speak to us if you would like alternate days and times.
Your 2-hr kids party can be held between these time slots:
Saturday Events: between 10am to 12pm and 2pm to 4pm
Sunday Events: 10am to 12pm or 2pm till 4pm
Speak to us if you would like alternate days and times.
With 3hr off-site paint and sip events, there is additional flexibility with your time slot. However, the events must fall within a morning, afternoon and evening time-slot, subject to availability.
Arrival and Departure Time
Your 3hr event duration is the entire time you have available to you to hold your event. It includes your arrival time, guest mingling time and your painting time. The agreement entered into with US will clearly state your Arrival Time and your Departure Time and the Duration of your event.

Wheelchair Access
Our studios is wheelchair accessible.
Offsite Events
It is your responsibility to provide tables and chairs at any offsite venue and to provide us with access to running water.
Your Deposit Payment
A non-refundable 50% deposit is required to secure your event’s date and time.The non-refundable deposit varies for off-site events and for events securing a studio public session timeslot.
Your Final Payment
Your final payment is due 48 hours prior to your event date.
Once attendee numbers are finalised, no refund will be provided if fewer attendees arrive at the event.
Rescheduling or Cancelling Your Event
A request to reschedule your event is a request to cancel it. Upon its cancellation, you will have the option to rebook your event at a future, available time.
If you are entitled to a credit, WE will issue you a voucher which you may use towards rebooking your private event or to put the credit towards another Creative Pair Studio Pty Ltd offering.
You may be entitled to a credit depending on when you give US written notice to reschedule or cancel your event:
Cancellation by the Government due to Covid or Covid related reasons
WE will make every effort to deliver OUR services to you, as promised.
However, if WE are required or effectively required by the Government to close OUR studio (whether it be the Federal or relevant State government, municipality or other governing body), and WE are therefore unable to run your event, WE will issue you a credit for the full value of your order or reschedule you to another date and time of your choice of equivalent value (subject to availability).
Alternatively, if WE are required or effectively required to reduce the capacity of OUR studio rather than close, WE will issue a credit for the full value of your order or reschedule you to another session of your choice of equivalent value (subject to availability) for the number of guests that were to attend but for exceeding the reduced studio capacity.
Our Private Party Terms and Conditions prevail
If a conflict exists between any of Our Private Party terms and conditions with any of Our General terms and conditions, the Private Party terms and conditions prevail in so far as the conflict exists as determined by US.
Definitions
‘Party’, ‘Event’, ‘Private Party’ and ‘Private Event’ “session” “Art Class” are used interchangeably throughout this website. They each hold the same meaning.
PRIVACY POLICY
In this Privacy Policy, Creative Pair Studio Pty Ltd may be referred to as ‘US’, ‘OUR’ or ‘WE’.
Your Personal Information
As the user of the website or facility and the purchaser of any of OUR goods and services, you agree and consent that WE may collect your contact information (your name, email, telephone number, date of birth, other contact detail) to complete session bookings and as a means for US to communicate with you from time to time OUR goods and services and related matters.
Please note that WE do not share or use this information with outside parties except to the extent required by law and when we engage third party service providers to provide you with related services that WE offer to you through our website, to conduct quality assurance testing, to provide technical support or to provide specific services to you. These third party service providers are required to not use your personal information other than to provide the services requested by US.
Your Email Address
WE collect an email address from persons making session bookings, requesting information and who sign up to receive OUR newsletter, promotional and advertising material. The email addresses WE collect are stored in a secure area within the site database and may be used for marketing purposes and developing promotional offers and sale events.
Your Credit Card Information
OUR website is a secure site and all credit cards are processed by a secure bank approved payment gateway. Your credit card payments are processed securely.
When you book through our website, WE do not keep your credit card details and they are only passed to the bank for processing a credit card payment.
When you book over the telephone, WE use your credit card details provided to us to process your credit card payment and then securely discard the information.
When booking private events, WE retain your credit card details provided to us until after your event and all payments are made by you. WE then securely discard the information.
Photographs and Videography taken of you by US
By registering and attending a session, you expressly and impliedly authorise and permit US to use any recordings WE make, which may contain images of you, for the promotion and advertising of OUR business.
